  1. Lustum Services

  2. Lustum operates the Lustum App, which is a software application, user interface and access layer through which eligible users may access certain services made available by Third-Party Providers, including Crossmint, Rain, and their respective affiliates, regulated partners, issuing partners, verification providers, card networks, processors, banking partners and other service providers.

  3. Through the Lustum App, eligible users may be able to access or interact with certain features, including: (i) account and profile functionality within the Lustum App; (ii) access to onboarding and verification processes required by Third-Party Providers; (iii) non-custodial wallet functionality provided by a Third-Party Provider; (iv) Onramp and Offramp services provided by Crossmint or its regulated partners; (v) card-related services provided by Rain, Signify, an issuer, card network, processor or another card programme partner; (vi) information, balances, transaction history, card status, wallet status, service status and related data received from Third-Party Providers; (vii) App tools that allow you to submit requests, instructions or confirmations to Third-Party Providers.

  4. Lustum provides the App Layer only and any Third-Party Service accessed through the Lustum App is provided by the relevant Third-Party Provider, including their respective partners and not by Lustum. You will be required to accept that provider’s own terms, privacy notices, disclosures and policies before using the relevant Third-Party Service. Lustum does not guarantee that any Third-Party Provider will approve you, continue serving you, process any transaction, issue or maintain any card, support any Digital Asset, support any jurisdiction, or make any feature available to you.

  5. Lustum does not itself provide any Regulated Service. In particular, Lustum does not provide banking, payment, card issuing, card programme management, money transmission, money remittance, stored value, e-money, digital asset exchange, digital asset custody, Onramp, Offramp, investment, trading, brokerage, financial advisory, tax advisory or legal advisory services. In addition, Lustum does not receive, hold, control, safeguard, manage, transmit, convert, redeem, settle or pay out your fiat funds or Digital Assets. Lustum does not operate a bank account, payment account, e-money account, stored value account, custodial wallet or trading account for you.

  6. Lustum does not make final onboarding, KYC, KYB, AML and CFT Requirements, sanctions, transaction approval, transaction rejection, card approval, card authorization, wallet acceptance, redemption, settlement or payout decisions. Those decisions are made by the relevant Third-Party Provider.

  7. Lustum may facilitate the technical transmission of requests, confirmations, instructions, or other information from you to a Third-Party Provider through the Lustum App. This does not mean that Lustum provides the underlying Third-Party Service or becomes responsible for the approval, execution, settlement, completion, rejection, or outcome of that request, confirmation, instruction, or information.

  8. Lustum may facilitate the technical transmission of information that may include, but are not limited to - requests, confirmations or instructions from you to a Third-Party Provider through the Lustum App. This does not mean that Lustum provides the underlying Third-Party Service or becomes responsible for the approval, execution, settlement, completion, rejection or outcome of that request, confirmation or instruction.

  9. Lustum may provide user support only for the Lustum App, including support relating to Account access, interface issues, App Layer functionality, and general user experience. Any request, complaint, dispute, refund, reversal, chargeback, card issue, Onramp, Offramp, Wallet, KYC, KYB, AML and CFT Requirements, transaction approval, card authorization, settlement, payout, or other matter relating to a Regulated Service or Third-Party Service must be addressed to the relevant Third-Party Provider under that provider’s terms. Lustum will use commercially reasonable efforts to assist users by identifying the relevant Third-Party Provider, facilitating communication where appropriate, and providing information actually held by Lustum, but Lustum is not responsible for approving, rejecting, processing, reversing, settling, resolving, or otherwise deciding any matter relating to a Regulated Service or Third-Party Service.

  10. Lustum may charge Fees for access to or use of the Lustum App, the App Layer, software features, user interface, account tools, subscription features or other app-level services.

  11. The availability of the Lustum App and any Third-Party Service may depend on your location, eligibility, provider approval, applicable law, sanctions requirements, Third-Party Provider policies, supported assets, supported jurisdictions, technical availability, operational and compliance requirements.

  12. Lustum may add, remove, suspend, restrict or change any feature of the Lustum App from time to time. Third-Party Providers may also add, remove, suspend, restrict or change their services, supported assets, supported jurisdictions, pricing, limits, onboarding requirements, card features, wallet features or other functionality. Lustum does not control those Third-Party Provider decisions.

  13. Nothing in these Terms should be read as Lustum offering, providing or agreeing to provide any Regulated Service. Lustum’s role is limited to operating the Lustum App and making the App Layer available so that eligible users may access Third-Party Services provided by Third-Party Providers.

  14. Third-Party Providers’ Services

  15. Certain features made available through the Lustum App are provided by Third-Party Providers. Before accessing or using a Third-Party Service, you may be required to review and accept the applicable Provider Terms, which may include, but not limited to user agreements, cardholder agreements, wallet terms, Onramp terms, Offramp terms, privacy notices, fee schedules, risk disclosures, acceptable use rules, sanctions policies, and other terms or policies issued by the relevant Third-Party Provider.

  16. By using a Third-Party Service, you enter into a separate legal relationship with the relevant Third-Party Provider. Lustum is not a party to that relationship unless expressly stated in writing. You are responsible for complying with all Provider Terms that apply to your use of any Third-Party Service. A breach of Provider Terms may result in suspension, restriction, rejection, cancellation, reversal, termination, or other action by the relevant Third-Party Provider, and may also result in suspension or termination of your access to the Lustum App.

  17. Access to a Third-Party Service is subject to the relevant Third-Party Provider’s onboarding, verification, eligibility, compliance, risk, operational, and approval requirements. A Third-Party Provider may require additional information from you and may approve, reject, delay, suspend, restrict, or terminate your access to its services in accordance with its own terms and requirements.

  18. If there is any conflict between these Terms and the Provider Terms in relation to a Third-Party Service, the Provider Terms will govern your use of that Third-Party Service. These Terms will continue to govern your use of the Lustum App and your relationship with Lustum.

  19. Third-Party Providers may change their Provider Terms, fees, supported jurisdictions, supported assets, limits, onboarding requirements, card requirements, wallet requirements, or other service conditions from time to time. Lustum does not control those changes, but may be required to reflect them in the Lustum App or restrict access to affected features.

  20. You authorize Lustum to display Provider Terms, collect your confirmations, transmit information or instructions to Third-Party Providers, receive status updates from Third-Party Providers, and take app-level steps reasonably necessary to facilitate your access to Third-Party Services.

  21. Nothing in these Terms limits any right of a Third-Party Provider to enforce its own Provider Terms, make service decisions, conduct compliance checks, decline transactions, suspend access, or terminate its relationship with you.

  22. Use of the Lustum App

  23. When you use the Lustum App to access a Third-Party Service, any request, instruction, confirmation, consent, transaction request or other action submitted by you through the Lustum App is treated as submitted by you to the relevant Third-Party Provider.

  24. Lustum may technically facilitate that process by displaying Third-Party Service provider screens, collecting your confirmations, transmitting information or instructions, receiving status updates, showing service information, and enabling app-level workflows required for the relevant Third-Party Service.

  25. Lustum does not exercise discretion over whether a Third-Party Service is provided to you, whether a transaction is approved or rejected, whether a card is issued or maintained, whether a wallet address is accepted, whether an Onramp or Offramp request is completed, or whether any provider-side compliance requirement is satisfied.

  26. You are responsible for ensuring that any information, confirmation, wallet address, transaction request, card instruction or other instruction you submit through the Lustum App is accurate, complete, lawful and intended by you.

  27. Once you submit an instruction or request through the Lustum App, it may be processed by the relevant Third-Party Provider in accordance with that provider’s terms. Lustum may not be able to cancel, amend, reverse, delay or intervene in that instruction or request once it has been submitted to the relevant Third-Party Provider.

  28. Information shown in the Lustum App, including balances, wallet information, card information, transaction information, onboarding status, limits, fees, supported assets, supported jurisdictions and service availability, may be based on information received from Third-Party Providers. The records and determinations of the relevant Third-Party Provider will prevail in relation to the Third-Party Service it provides.

  29. Lustum may take app-level actions where required to reflect a decision, requirement or instruction of a Third-Party Provider, including disabling access to a feature, updating a status, restricting a function, displaying a notice, requesting additional information, or directing you to the relevant Third-Party Provider.

  30. Lustum does not act as your trustee, fiduciary, broker, investment adviser, payment agent, remittance agent, card issuer, custodian or representative in relation to any Third-Party Service. Lustum’s role is limited to operating the Lustum App and facilitating app-level access to Third-Party Services.

  31. Eligibility

  32. You may use the Lustum App only if you satisfy all eligibility requirements set out in these Terms, the applicable Provider Terms and Applicable Law.

  33. If you are an individual, you must: (i) be at least 18 years old, or the age of legal capacity in your jurisdiction, whichever is higher; (ii) have full legal capacity to enter into these Terms; (iii) use the Lustum App for your own account and not on behalf of another person, unless expressly permitted by Lustum and the relevant Third-Party Provider; (iv) provide true, accurate, complete and up-to-date information during registration, onboarding and continued use of the Lustum App; (v) not be located in, resident in, ordinarily resident in, or accessing the Lustum App from a Prohibited Jurisdiction; (vi) not be subject to sanctions, trade restrictions or any restricted party list; (vii) ensure that your use of the Lustum App and any Third-Party Service is lawful in the jurisdiction from which you access or use them.

  34. If you use the Lustum App on behalf of a company or other legal entity, you represent that: (i) the entity is duly incorporated, validly existing and lawfully able to use the Lustum App; (ii) you are duly authorised to accept these Terms on behalf of that entity; (iii) the entity is not incorporated, established, managed from, operating from, or accessing the Lustum App from a Prohibited Jurisdiction; (iv) the entity, its directors, beneficial owners, authorised representatives and controllers are not subject to sanctions, trade restrictions or any restricted party list; (v) the entity’s use of the Lustum App and any Third-Party Service is lawful in the relevant jurisdictions.

  35. You may not use the Lustum App if you are prohibited from doing so under Applicable Law, these Terms, any Provider Terms and policies.

  36. You must maintain your eligibility at all times. If your location, residence, authority, sanctions status, legal capacity, business status or any other eligibility-related information changes, you must stop using the affected features and notify Lustum and respective Third-Party Provider without undue delay.

  37. Access to the Lustum App does not mean that you are eligible to use any Third-Party Service. Each Third-Party Provider may apply its own eligibility, onboarding, verification, risk, compliance and approval requirements.

  38. We may require you to provide information or documents to verify your eligibility. We may refuse, suspend, restrict or terminate your access to the Lustum App if: (i) you do not satisfy these eligibility requirements; (ii) you fail to provide requested information; (iii) we cannot verify your eligibility; (iv) a Third-Party Provider rejects, suspends or terminates your access; (v) your continued access may create legal, regulatory, sanctions, compliance, provider, operational or reputational risk.

  39. You must not create or use multiple accounts, allow another person to use your account, transfer your account, or use another person’s account, unless expressly permitted by Lustum and the relevant Third-Party Provider.

  40. Prohibited Jurisdictions

  41. The Lustum App and the Third-Party Services are not available in all jurisdictions. Access to the Lustum App and to any Third-Party Service is subject to the countries, territories, regions and users supported by the relevant Third-Party Provider.

  42. You must not open, maintain or use an Account, or access or use any Third-Party Service, if you are located in, resident in, ordinarily resident in, incorporated in, established in, or accessing the Lustum App from a Prohibited Jurisdiction.

  43. A Prohibited Jurisdiction means any country, territory or region that is identified as prohibited, restricted or unsupported by a Third-Party Provider in its Provider Terms, sanctions policy, prohibited jurisdictions list, supported countries list, compliance policy, or otherwise notified through the Lustum App. A Prohibited Jurisdiction also includes any country, territory or region where access to the Lustum App or a Third-Party Service is restricted under Applicable Law, sanctions requirements, or Third-Party Provider requirements.

  44. You must not access or use the Lustum App or any Third-Party Service if you, or any person or entity on whose behalf you act, are listed on, owned or controlled by a person listed on, or otherwise subject to restrictions under, any Sanctions List.

  45. You must not use a virtual private network, proxy, false address, false residency information, remote access tool or similar method to bypass any country, territory, sanctions, provider eligibility or location-based restriction.

  46. Availability may differ by service. A country, territory or region may be supported for one Third-Party Service but prohibited, restricted or unsupported for another Third-Party Service.

  47. The relevant Third-Party Provider is responsible for determining whether you are eligible to use the Third-Party Service it provides. Lustum may rely on information made available by you, by Third-Party Providers, through the Lustum App, or through technical signals reasonably available at the app layer to restrict access where required.

  48. Lustum may refuse, suspend, restrict or terminate your access to the Lustum App or any feature if you appear to be located in, resident in, ordinarily resident in, incorporated in, established in, or accessing from a Prohibited Jurisdiction, if you appear to be subject to sanctions or restricted-party controls, or if a Third-Party Provider requires or requests restriction.

  49. Prohibited Jurisdictions and supported jurisdictions may change from time to time. If a Third-Party Provider updates its restricted or supported countries, territories or regions, Lustum may update these Terms, the Lustum App, or the availability of affected features accordingly.

  50. Account Registration and Security

  51. To use the Lustum App, you need to create an Account.

  52. You agree to provide true, accurate, complete, and up-to-date information. You must promptly update your information if it changes without undue delay.

  53. You are responsible for maintaining the security of your Account, device, login credentials, passkeys and any other access method used to access the Lustum App.

  54. You must not share your Account, login credentials or access methods with any other person, and you must not allow any other person to use your Account.

  55. You must notify Lustum immediately if you become aware of, or suspect, any unauthorised access to your Account, loss of credentials, compromised device, security breach or other misuse of your Account.

  56. Lustum may suspend, restrict or disable access to your Account where we reasonably believe this is necessary to protect you, Lustum, other users, Third-Party Providers, or the security and integrity of the Lustum App.

  57. You are responsible for all activity carried out through your Account, except to the extent caused by Lustum’s own fraud, wilful misconduct or gross negligence.

  58. Third-Party Provider Onboarding and Verification

  59. To access certain Third-Party Services through the Lustum App, you may be required to complete onboarding, identity verification, business verification, sanctions screening, AML and CFT checks, customer due diligence, risk checks, or other compliance steps required by the relevant Third-Party Provider.

  60. These checks are performed for the relevant Third-Party Provider. Lustum does not perform KYC, KYB, AML, CFT, sanctions screening or customer due diligence as the provider of any Regulated Service, and Lustum does not make the final decision on whether you may access any Regulated Service.

  61. Lustum may display or facilitate access to onboarding or verification screens within the Lustum App. Information submitted through those screens may be transmitted to the relevant Third-Party Provider or its verification providers, regulated partners, issuing partners, card programme partners, processors, banking partners or other service providers.

  62. Lustum may receive limited status information or operational information from a Third-Party Provider, such as whether your onboarding has been approved, rejected, is pending, or requires further information. Lustum uses this information to operate the Lustum App and enable or restrict access to features.

  63. You must provide all information and documents requested by the relevant Third-Party Provider accurately, completely and without delay. If you fail to do so, the relevant Third-Party Provider may reject, delay, suspend or terminate your access to its services, and Lustum may restrict the related feature in the Lustum App.

  64. You authorize Lustum to facilitate the submission of information, documents, confirmations, consents and instructions to the relevant Third-Party Provider for onboarding, verification, compliance and service-access purposes.

  65. Lustum may not be able to modify, correct, withdraw, approve or reject information once it has been submitted to a Third-Party Provider. Requests relating to provider onboarding, verification status or provider compliance decisions may need to be addressed directly to the relevant Third-Party Provider.

  66. Non-Custodial Wallets

  67. The Lustum App may allow you to access Non-Custodial Wallet functionality provided by Third-Party Provider.

  68. A Non-Custodial Wallet means that you own or control the assets held in that Wallet and are responsible for the security of your wallet access credentials, passkeys, recovery methods, devices, and account access.

  69. Lustum does not hold your private keys. Lustum does not custody your Digital Assets. Lustum cannot recover Digital Assets if you lose access to your Wallet or credentials.

  70. You are solely responsible for: (i) keeping your Wallet credentials secure; (ii) ensuring that any wallet address you use is correct; (iii) ensuring that you use the correct asset and blockchain network; (iv) understanding that blockchain transactions may be irreversible; (v) ensuring that you do not send assets to unsupported wallets, unsupported networks, incorrect addresses, or prohibited addresses; (vi) any loss arising from your own wallet misuse, compromised credentials, device loss, user error, or unauthorized access.

  71. A Third-Party Provider may require you to verify that a Wallet address belongs to you or is controlled by you before allowing you to use that Wallet for a Third-Party Service.

  72. Lustum may provide app-level tools that allow you to complete wallet creation, wallet connection, wallet attribution, cryptographic signature, passkey verification or similar steps required by a Third-Party Provider.

  73. Final acceptance of any Wallet address for a Third-Party Service is determined by the relevant Third-Party Provider and not by Lustum.

  74. You must not use a Wallet that belongs to another person unless you have lawful authority to do so. You must not use a Wallet connected to sanctions, fraud, illegal activity, Prohibited Jurisdictions, unsupported networks or other restricted activity.

  75. Onramp and Offramp Services

  76. The Lustum App may allow you to access Onramp and Offramp services provided by a Third-Party Provider.

  77. Onramp services may allow eligible users to purchase or receive supported Digital Assets using supported fiat payment methods or other payment methods accepted by the relevant Third-Party Provider.

  78. Offramp services may allow eligible users to redeem, sell, convert or otherwise exchange supported Digital Assets into fiat currency through the relevant Third-Party Provider.

  79. Lustum does not provide Onramp or Offramp services. Lustum does not receive fiat funds from you for Onramp transactions, does not convert fiat into Digital Assets, does not receive Digital Assets from you for redemption, does not redeem Digital Assets for fiat currency, and does not settle, hold or pay out fiat proceeds to you.

  80. Onramp and Offramp transactions are subject to the relevant Third-Party Provider’s Provider Terms, onboarding, approval, supported jurisdictions, supported assets, pricing, fees, limits, compliance checks, transaction review, settlement timing and operational requirements.

  81. A Third-Party Provider may approve, reject, delay, suspend, cancel, reverse or refuse to process any Onramp or Offramp transaction for legal, regulatory, sanctions, AML and CFT Requirements, fraud, risk, security, banking partner, payment partner, blockchain network, wallet, asset-support or operational reasons.

  82. You are responsible for ensuring that any wallet address, payment method, bank account, Digital Asset, blockchain network, transaction request or other information you submit for an Onramp or Offramp transaction is accurate, complete, lawful and belongs to you or is lawfully controlled by you.

  83. Onramp and Offramp transactions may be final or irreversible once submitted, processed, settled, broadcast to a blockchain network, or otherwise completed by the relevant Third-Party Provider. Lustum may not be able to cancel, amend, reverse or recover any transaction once it has been submitted to the relevant Third-Party Provider.

  84. The availability, pricing, limits, fees, exchange rates, settlement timing and supported Digital Assets for Onramp and Offramp services are determined by the relevant Third-Party Provider and may change from time to time.

  85. Any receipt, confirmation, transaction status, settlement information or other information displayed in the Lustum App in relation to an Onramp or Offramp transaction may be based on information received from the relevant Third-Party Provider. The records and determinations of the relevant Third-Party Provider will prevail in relation to the Onramp or Offramp service it provides.

  86. Card Services

  87. The Lustum App may allow you to access Card Services provided by a Third-Party Provider, an issuer, card network, processor, programme manager or other card programme partner.

  88. Lustum does not issue cards, operate card accounts, authorise card transactions, process card payments, provide payment accounts, provide credit, provide stored value, or manage any card programme.

  89. Card Services are provided under the Provider Terms of the relevant Third-Party Provider, issuer, card network, processor or other card programme partner. You may be required to accept separate cardholder terms, issuer terms, fee schedules, risk disclosures and policies before using any card.

  90. The relevant Third-Party Provider, issuer or card programme partner is responsible for card approval, card issuance, card activation, card limits, card suspension, card termination, transaction authorisation, settlement, statements, disputes, refunds, reversals, chargebacks and other card programme matters.

  91. A card transaction may be approved, declined, delayed, reversed, disputed, charged back, suspended or cancelled for reasons determined by the relevant Third-Party Provider, issuer, card network, processor, merchant, acquirer, banking partner or other card programme participant.

  92. You are responsible for using any card lawfully and in accordance with the applicable Provider Terms. You must not use any card for prohibited activity, unsupported merchants, unsupported jurisdictions, unlawful transactions, sanctions evasion, fraud, money laundering, terrorist financing, or any activity prohibited by the relevant Third-Party Provider, issuer, card network or Applicable Law.

  93. The Lustum App may display card information, card status, transaction information, spending information, limits, fees or other card-related information received from a Third-Party Provider. This information is provided for convenience and may be delayed, incomplete, inaccurate, reversed, corrected or updated by the relevant Third-Party Provider.

  94. Any suspected unauthorised transaction, billing error, card dispute, merchant dispute, refund request, chargeback, reversal, card suspension or card termination must be raised through the process required by the relevant Third-Party Provider or cardholder terms. Lustum may assist at the App Layer where appropriate, but Lustum does not decide card disputes, refunds, reversals, chargebacks or transaction outcomes.

  95. If a Card Service is funded, settled or connected with Digital Assets, Stablecoins, Wallets, Onramp or Offramp functionality, the relevant Third-Party Provider remains responsible for the underlying Card Service and related provider-side processing. Lustum does not itself convert, redeem, settle, hold or pay out fiat funds or Digital Assets in connection with any card transaction.

  96. If Rain, Signify, an issuer, card network, processor, banking partner, or other card programme partner charges, allocates, debits, or passes to Lustum any provisional credit, fraud loss, chargeback, force post, negative balance write-off, insufficient funds amount, dispute cost, or other related card programme loss in connection with your Account, your card, your use of Card Services, or any card transaction linked to you, Lustum may recover that amount from you only to the extent the loss is reasonably attributable to your breach of these Terms or Provider Terms, your fraud, misuse, abusive activity, false or unsupported dispute, unauthorised instruction, or your failure to take reasonable security precautions in relation to your Account, card, device, credentials, passkeys, or access methods.

  97. If Lustum demands reimbursement under Section 11.10, you must pay the amount due by the date stated in the demand. If you fail to pay on time, the unpaid amount may accrue interest at the lower of 1.5% per month and the maximum rate permitted by Applicable Law, from the due date until full payment. You must also reimburse Lustum for reasonable collection costs incurred in recovering the outstanding amount.

  98. Records, notices, determinations, or reports provided by the relevant Third-Party Provider, issuer, card network, processor, merchant, acquirer, banking partner, or other card programme participant may be relied on by Lustum as evidence of the relevant card programme loss, unless manifestly incorrect.

  99. Terms 11.10, 11.11 and 11.12 do not apply to the extent the relevant loss is caused directly by Lustum’s own fraud, wilful misconduct, or gross negligence.

  100. User Instructions Through the Lustum App

  101. The Lustum App may allow you to submit requests, confirmations, consents, wallet actions, card actions, Onramp requests, Offramp requests, transaction requests or other instructions in connection with the Lustum App or a Third-Party Service.

  102. When you submit an instruction through the Lustum App in connection with a Third-Party Service, you authorize the relevant Third-Party Provider, issuer, card programme partner, wallet infrastructure provider, processor, banking partner or other service provider to process that instruction in accordance with its Provider Terms.

  103. Lustum may transmit, display, route or technically facilitate your instruction at the App Layer. Lustum does not become the provider of the underlying Third-Party Service by doing so.

  104. You are responsible for ensuring that each instruction you submit is accurate, complete, lawful, intended by you, and submitted from an Account, Wallet, device or access method that you are authorized to use.

  105. Once submitted, an instruction may not be capable of being cancelled, amended, reversed, delayed, recovered or stopped by Lustum. This is especially important for wallet transactions, blockchain transactions, Onramp and Offramp transactions, and card transactions.

  106. Lustum is not responsible for any loss, delay, rejection, reversal, failed transaction, unsupported transaction, incorrect address, incorrect network, incorrect payment method, incorrect card instruction or other issue arising from an instruction submitted by you, except to the extent caused by Lustum’s own fraud, wilful misconduct or gross negligence.

  107. Fees

  108. Lustum may charge Fees for access to or use of the Lustum App, the App Layer, software features, account tools, subscription features, or other app-level services.

  109. Third-Party Providers may separately charge Fees for Third-Party Services, including Card Services, Onramp, Offramp, Wallet, network, gas, processing, transaction, foreign exchange, issuer, card network, or other provider-related Fees.

  110. Any Fees payable by you will be disclosed before they are charged, unless they are network fees, gas fees, pass-through costs, or other variable charges that cannot reasonably be determined in advance.

  111. Fees may change from time to time. Third-Party Provider Fees are determined by the relevant Third-Party Provider and may be changed under the applicable Provider Terms.

  112. Fees charged by Lustum are charged for app-level services only and not for Lustum providing banking, payment, card issuing, money transmission, money remittance, stored value, digital asset exchange, digital asset custody, Onramp, Offramp, investment, or financial advisory services.

  113. Risk Disclosures

  114. You acknowledge that use of the Lustum App, Digital Assets, Stablecoins, Wallets, Card Services, Onramp, Offramp and other Third-Party Services involves risk. You access and use them at your own risk.

  115. Digital Assets may lose value, become illiquid, become unavailable, become unsupported, or be subject to sudden market, technical, legal, operational or regulatory changes. The value of a Digital Asset may change significantly and quickly.

  116. A Stablecoin may lose its peg, become unavailable, become unsupported, be frozen, be restricted, be affected by issuer risk, reserve risk, redemption risk, market risk, operational risk, legal risk or regulatory risk.

  117. Digital Assets are not deposits and are not bank balances. They may not be legal tender and may not be protected by any deposit protection, investor compensation, insurance, chargeback or similar scheme, unless expressly stated by the relevant Third-Party Provider and required under Applicable Law.

  118. Blockchain transactions may be final and irreversible. If you send Digital Assets to the wrong address, use the wrong network, use an unsupported asset, interact with an unsupported Wallet, or submit incorrect transaction details, the Digital Assets may be permanently lost.

  119. Blockchain networks may experience congestion, outages, delays, forks, attacks, software bugs, validator issues, smart contract failures, node failures, gas volatility or other technical issues. These events may delay, fail, reverse, limit or otherwise affect transactions or access to Digital Assets.

  120. If you use a Non-Custodial Wallet, you are responsible for securing your Wallet credentials, passkeys, recovery methods, devices and account access. If you lose access to your Wallet, credentials or recovery method, you may permanently lose access to the Digital Assets connected to that Wallet.

  121. Onramp and Offramp transactions may be delayed, rejected, cancelled, suspended, reversed or subject to additional checks by the relevant Third-Party Provider. This may happen for legal, regulatory, sanctions, AML and CFT Requirements, fraud, risk, banking partner, payment partner, liquidity, asset-support, wallet, network or operational reasons.

  122. Prices, exchange rates, spreads, Fees, gas fees, network fees, card fees, limits, supported assets, supported networks, supported jurisdictions and settlement times may change. The relevant Third-Party Provider determines these matters for its own services.

  123. Card transactions may be approved, declined, delayed, reversed, disputed, charged back, suspended or cancelled. These outcomes may result from issuer decisions, card network rules, merchant actions, acquirer actions, processor outages, fraud controls, sanctions checks, compliance reviews, insufficient balances, unsupported merchants, unsupported jurisdictions or other factors outside Lustum’s control.

  124. Third-Party Services may be changed, suspended, restricted, discontinued or made unavailable by the relevant Third-Party Provider. Lustum does not control Third-Party Provider decisions, provider systems, provider risk controls, provider compliance checks, provider pricing, provider supported jurisdictions or provider supported assets.

  125. Regulatory treatment of Digital Assets, Stablecoins, Wallets, Card Services, Onramp, Offramp and related services may change. A change in Applicable Law, provider policy, sanctions requirements or regulatory expectations may affect your ability to access or use the Lustum App or any Third-Party Service.

  126. Information shown in the Lustum App may be based on information received from Third-Party Providers. It may be delayed, incomplete, inaccurate, reversed, corrected or updated by the relevant Third-Party Provider.

  127. Lustum does not provide investment, financial, trading, tax, legal or accounting advice. Nothing in the Lustum App is a recommendation, solicitation, offer or advice to buy, sell, hold, exchange, redeem, spend or otherwise use any Digital Asset, Stablecoin, card product, payment product or financial product.

  128. You are responsible for understanding the risks of any Digital Asset, Stablecoin, Wallet, Card Service, Onramp, Offramp or other Third-Party Service before using it. You should not use the Lustum App or any Third-Party Service if you do not understand the relevant risks.

  129. Service Availability and Changes

  130. The Lustum App and the Third-Party Services may not be available at all times, in all jurisdictions, or for all users.

  131. Access to the Lustum App may be affected by maintenance, updates, technical issues, network outages, security incidents, provider issues, system failures, blockchain network conditions, card network issues, regulatory requirements, operational decisions, or other events.

  132. Third-Party Providers may change, suspend, restrict, discontinue, or remove any Third-Party Service at any time. This may include changes to supported assets, supported networks, supported jurisdictions, Fees, pricing, limits, onboarding requirements, compliance requirements, Wallet features, Card Services, Onramp, Offramp, settlement timing, or transaction availability.

  133. Lustum does not control the availability, operation, approval process, transaction processing, pricing, limits, supported jurisdictions, supported assets, or service conditions of any Third-Party Service.

  134. Lustum may update, modify, suspend, restrict, or discontinue any part of the Lustum App where we consider it necessary or appropriate for legal, regulatory, sanctions, compliance, security, technical, provider, operational, or business reasons.

  135. We may also restrict, suspend, or disable access to any feature of the Lustum App where required or requested by a Third-Party Provider, issuer, card network, banking partner, regulator, court, law enforcement authority, or Applicable Law.

  136. Where reasonably practicable, we will take reasonable steps to notify you of material changes to the Lustum App that may materially affect your use of the Lustum App. We may make changes without prior notice where immediate action is required for legal, regulatory, sanctions, compliance, security, technical, provider, operational, or business reasons.

  137. Lustum does not guarantee that the Lustum App or any Third-Party Service will be uninterrupted, error-free, secure, available at any particular time, available in any particular jurisdiction, or compatible with any particular device, network, Wallet, Digital Asset, card, provider, or service.

  138. Your Responsibilities

  139. You are responsible for your use of the Lustum App and for any activity carried out through your Account.

  140. You must use the Lustum App only for lawful purposes and in accordance with these Terms, the applicable Provider Terms, and Applicable Law.

  141. You must provide true, accurate, complete and up-to-date information whenever information is requested through the Lustum App or by a Third-Party Provider.

  142. You are responsible for keeping your Account, device, login credentials, passkeys, Wallet access, card access, recovery methods and any other access method secure.

  143. You must promptly notify Lustum if you become aware of, or suspect, any unauthorized access to your Account, compromised credentials, compromised device, unauthorized transaction, or other security issue affecting your use of the Lustum App.

  144. You are responsible for ensuring that any request, instruction, confirmation, transaction request, Wallet address, card instruction, payment method, bank account details, or other information submitted through the Lustum App is accurate, complete, lawful, and intended by you.

  145. You must not use the Lustum App or any Third-Party Service in a way that may breach Applicable Law, Provider Terms, sanctions requirements, card network rules, issuer requirements, banking partner requirements, or any restriction made available through the Lustum App.

  146. You are responsible for reviewing and understanding any Fees, limits, supported assets, supported networks, supported jurisdictions, Provider Terms, risk disclosures, and transaction details before using any feature or Third-Party Service.

  147. You are responsible for any taxes, duties, reporting obligations or other governmental charges that may apply to your use of the Lustum App, Digital Assets, Wallets, Card Services, Onramp, Offramp, Fees, rewards, or Third-Party Services.

  148. You must not allow another person to use your Account, and you must not use another person’s Account, Wallet, card, identity, credentials, device, payment method, or bank account unless you have lawful authority and the relevant Third-Party Provider permits it.

  149. You must not use the Lustum App to access or use any Third-Party Service from a Prohibited Jurisdiction or in breach of any provider eligibility requirement.

  150. If you no longer satisfy any eligibility requirement under these Terms or any applicable Provider Terms, you must stop using the affected feature or Third-Party Service immediately.

  151. Prohibited Activity

  152. You must not use the Lustum App or any Third-Party Service for any unlawful, fraudulent, abusive, harmful or prohibited purpose.

  153. You must not use the Lustum App or any Third-Party Service to engage in, facilitate, support, or attempt to engage in:

  154. money laundering, terrorist financing, sanctions evasion, fraud, scams, phishing, account takeover, identity theft, or use of stolen credentials;

  155. illegal gambling, illegal gaming, unlawful betting, or unlawful lottery activity;

  156. market manipulation, wash trading, front-running, pump-and-dump activity, spoofing, layering, insider dealing, deceptive trading, or other abusive market conduct;

  157. unlawful securities, derivatives, investment, lending, credit, fundraising, or collective investment activity;

  158. unlawful money transmission, remittance, payment processing, card issuing, stored value, digital asset exchange, custody, Onramp, Offramp, or other regulated activity;

  159. transactions involving sanctioned persons, sanctioned wallets, restricted persons, blocked persons, Prohibited Jurisdictions, prohibited merchants, prohibited networks, prohibited addresses, or unsupported assets;

  160. malware, ransomware, cybercrime, hacking, credential harvesting, unauthorized access, denial-of-service attacks, or interference with systems, networks, APIs, wallets, cards, or security controls;

  161. illegal goods or services, weapons, controlled substances, counterfeit goods, stolen goods, human exploitation, terrorist content, extremist content, or any activity that a Third-Party Provider, issuer, card network, banking partner, or Applicable Law prohibits.

  162. You must not:

  163. bypass, disable, interfere with, or attempt to circumvent any security, identity, jurisdiction, sanctions, compliance, risk, fraud, card, wallet, provider, or location-based control;

  164. use a VPN, proxy, false address, false residency information, remote access tool, synthetic identity, nominee, mule account, or similar method to misrepresent your identity, location, eligibility, or control of an account, Wallet, card, or transaction;

  165. create, use, or control multiple Accounts to avoid limits, restrictions, Fees, eligibility checks, sanctions screening, provider controls, or transaction monitoring;

  166. use the Lustum App or any Third-Party Service on behalf of another person unless expressly permitted by Lustum and the relevant Third-Party Provider;

  167. submit false, incomplete, misleading, outdated, forged, stolen, or manipulated information, documents, confirmations, instructions, wallet details, payment details, or bank account details.

  168.  You must not use the Lustum App or any Third-Party Service in any manner that may expose Lustum, a Third-Party Provider, issuer, card network, banking partner, processor, regulated partner, service provider, or any other user to legal, regulatory, sanctions, fraud, security, operational, financial, or reputational risk.

  169. If we believe that you have engaged in Prohibited Activity, or if a Third-Party Provider notifies us or requires action, we may suspend, restrict, or terminate your access to the Lustum App or any feature, block or disable functionality, refuse to process app-level requests, preserve records, share relevant information with Third-Party Providers, and take any other action reasonably necessary to protect Lustum, users, Third-Party Providers, and the integrity of the Lustum App.

  170. User Support and Complaints

  171. Lustum may provide support for issues relating to the Lustum App, Account access, interface, App Layer functionality, and general user experience.

  172. Any request, complaint, dispute, refund, reversal, chargeback, card issue, Onramp, Offramp, Wallet, KYC, KYB, AML and CFT Requirements, transaction approval, card authorization, settlement, payout, or other matter relating to a Third-Party Service must be addressed to the relevant Third-Party Provider under that provider’s terms.

  173. Lustum will use commercially reasonable efforts to assist you by identifying the relevant Third-Party Provider, facilitating communication where appropriate, and providing information actually held by Lustum.

  174. Lustum is not responsible for approving, rejecting, processing, reversing, settling, resolving, or otherwise deciding any matter relating to a Third-Party Service.

  175. If you submit a complaint or support request to Lustum that relates to a Third-Party Service, you authorize Lustum to share relevant information with the relevant Third-Party Provider for the purpose of handling that complaint or request.

  176. You must provide all information reasonably requested by Lustum or the relevant Third-Party Provider in connection with any support request, complaint, dispute, refund, reversal, chargeback, investigation, or compliance review.

  177. Taxes

  178. You are solely responsible for determining whether any taxes, duties, levies, reporting obligations, filings, or other governmental charges apply to your use of the Lustum App or any Third-Party Service.

  179. This may include taxes or reporting obligations relating to Digital Assets, Stablecoins, Wallets, Card Services, Onramp, Offramp, transactions, Fees, rewards, gains, losses, spending, redemptions, conversions, transfers, or any other activity carried out through or in connection with the Lustum App.

  180. Lustum does not provide tax advice and does not determine, collect, report, or pay taxes on your behalf, except where expressly required by Applicable Law.

  181. You should obtain independent tax advice before using the Lustum App or any Third-Party Service if you are unsure about your tax position.

  182. You must provide any tax information, forms, declarations, or confirmations reasonably requested by Lustum or a Third-Party Provider where required by Applicable Law, Provider Terms, or provider compliance requirements.

  183. Privacy and Data Sharing

  184. Your personal data will be processed in accordance with our Privacy Policy.

  185. Third-Party Providers may process your personal data separately under their own privacy notices, Provider Terms, legal obligations, and compliance requirements. You should review the applicable privacy notices of each Third-Party Provider before using any Third-Party Service.

  186. Where you submit information through the Lustum App for onboarding, verification, KYC, KYB, AML and CFT Requirements, Wallet access, Card Services, Onramp, Offramp, support, complaints, or other Third-Party Services, that information may be made available to the relevant Third-Party Provider and its verification providers, regulated partners, issuing partners, card programme partners, processors, banking partners, or other service providers.

  187. Lustum may receive limited information from Third-Party Providers to operate the Lustum App. This may include onboarding status, account status, Wallet information, card status, transaction metadata, feature availability, limits, Fees, support information, compliance status, or other information required to provide app-level functionality.

  188. Lustum may share information with Third-Party Providers where necessary to operate the Lustum App, facilitate access to Third-Party Services, respond to support requests, investigate misuse, apply restrictions, comply with Applicable Law, or protect Lustum, users, Third-Party Providers, and the integrity of the Lustum App.

  189. Lustum does not control how Third-Party Providers process personal data for their own services. Third-Party Providers are responsible for their own processing activities, privacy notices, retention periods, security measures, and legal obligations.

  190. By using the Lustum App and accessing Third-Party Services through it, you acknowledge that your information may be processed by Lustum and by relevant Third-Party Providers for the purposes described in these Terms, the Privacy Policy, the Provider Terms, and applicable privacy notices.

  191. Intellectual Property

  192. The Lustum App, including its software, design, text, graphics, logos, content, features, functionality, interfaces, workflows, documentation, and other materials, is owned by Lustum or its licensors.

  193. Subject to these Terms, Lustum grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Lustum App for your own lawful use.

  194. You must not copy, modify, adapt, translate, reverse engineer, decompile, disassemble, reproduce, distribute, sell, lease, sublicense, exploit, scrape, frame, mirror, or create derivative works from the Lustum App or any part of it, except to the extent expressly permitted by Applicable Law.

  195. You must not remove, obscure, or alter any copyright, trademark, proprietary notice, branding, attribution, disclaimer, or provider notice displayed in or through the Lustum App.

  196. Nothing in these Terms transfers to you any ownership right, title, or interest in the Lustum App, Lustum’s intellectual property, or any intellectual property of a Third-Party Provider.

  197. Any feedback, suggestions, ideas, comments, or recommendations you provide about the Lustum App may be used by Lustum without restriction or compensation to you, provided that Lustum will not use your personal data except in accordance with its Privacy Policy.

  198. Suspension and Termination

  199. Lustum may suspend, restrict, or terminate your access to the Lustum App, your Account, or any feature of the Lustum App if:

  200. you breach these Terms;

  201. you breach any applicable Provider Terms;

  202. you no longer satisfy the eligibility requirements under these Terms or any Provider Terms;

  203. you provide false, incomplete, misleading, outdated, forged, stolen, or manipulated information;

  204. you engage in Prohibited Activity or we reasonably suspect that you have done so;

  205. you attempt to bypass jurisdictional, sanctions, provider, security, fraud, or location-based restrictions;

  206. a Third-Party Provider rejects, suspends, restricts, or terminates your access to a Third-Party Service;

  207. a Third-Party Provider, issuer, card network, processor, banking partner, regulated partner, service provider, regulator, court, law enforcement authority, or Applicable Law requires or requests suspension, restriction, or termination;

  208. continued access may create legal, regulatory, sanctions, fraud, security, operational, financial, provider, or reputational risk;

  209. the Lustum App or a relevant Third-Party Service is suspended, restricted, discontinued, or no longer available.

  210. Lustum may take any suspension, restriction, or termination action immediately and without prior notice where we consider this necessary for legal, regulatory, sanctions, fraud, security, provider, operational, or risk reasons.

  211. Suspension, restriction, or termination of your access to the Lustum App may affect your ability to access Third-Party Services through the Lustum App. It does not necessarily terminate your separate legal relationship with any Third-Party Provider.

  212. If your access to a Third-Party Service is suspended, restricted, or terminated by a Third-Party Provider, Lustum may reflect that decision in the Lustum App, including by disabling related features or limiting access to related information.

  213. You remain responsible for any Fees, obligations, liabilities, transactions, instructions, disputes, chargebacks, reversals, taxes, or other matters arising before suspension or termination.

  214. Following suspension or termination, Lustum may retain information as required or permitted by Applicable Law, its Privacy Policy, Provider Terms, or legitimate legal, regulatory, security, audit, dispute-resolution, fraud-prevention, or business purposes.

  215. Disclaimers

  216. The Lustum App is provided on an “as is” and “as available” basis.

  217. To the fullest extent permitted by Applicable Law, Lustum does not give any warranty, representation, undertaking, or condition that the Lustum App will be uninterrupted, error-free, secure, accurate, complete, available in any particular jurisdiction, or compatible with any particular device, network, Wallet, Digital Asset, card, provider, or service.

  218. Lustum does not give any warranty, representation, undertaking, or condition in relation to any Third-Party Service, Provider Terms, Digital Asset, Stablecoin, Wallet, Card Service, Onramp, Offramp, issuer, card network, processor, banking partner, regulated partner, or other third-party system or service.

  219. Lustum is not responsible for any decision, act, omission, delay, rejection, suspension, restriction, error, failure, outage, reversal, chargeback, dispute, settlement issue, unsupported asset, unsupported network, unsupported jurisdiction, compliance review, or service change of any Third-Party Provider.

  220. Lustum is not responsible for any loss arising from:

  226. changes in Applicable Law, regulatory expectations, sanctions requirements, Provider Terms, supported jurisdictions, supported assets, pricing, Fees, limits, or provider policies.

  227. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Applicable Law.

  228. Limitation of Liability

  229. To the fullest extent permitted by Applicable Law, Lustum will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for any loss of profit, revenue, business, goodwill, data, Digital Assets, opportunity, anticipated savings, or business interruption.

  230. To the fullest extent permitted by Applicable Law, Lustum will not be liable for any loss arising from or relating to any Third-Party Service, Provider Terms, provider decision, Digital Asset, Stablecoin, Wallet, Card Service, Onramp, Offramp, card transaction, blockchain transaction, payment transaction, provider outage, unsupported asset, unsupported network, unsupported jurisdiction, or any action or omission of a Third-Party Provider.

  231. To the fullest extent permitted by Applicable Law, Lustum’s total aggregate liability to you arising out of or relating to these Terms, the Lustum App, or your use of the Lustum App will not exceed the greater of:

  232. the Fees you paid directly to Lustum for use of the Lustum App during the three months before the event giving rise to the claim;

  233. or USD 100.

  234. The limitations in this Section apply whether the claim is based on contract, tort, negligence, breach of statutory duty, restitution, misrepresentation, or any other legal theory.

  235. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Applicable Law.

  236. Indemnity

  237. You agree to indemnify and hold harmless Lustum, its affiliates, directors, officers, employees, contractors, licensors, and service providers from and against any claim, loss, liability, damage, cost, or expense arising from or relating to:

  238. your breach of these Terms;

  243. your taxes, duties, filings, reporting obligations, or other governmental charges;

  244. your violation of Applicable Law, sanctions requirements, third-party rights, or provider restrictions;

  245. your attempt to access or use the Lustum App or any Third-Party Service from a Prohibited Jurisdiction;

  246. any claim made by a Third-Party Provider, issuer, card network, banking partner, processor, regulator, authority, or other third party arising from your acts, omissions, instructions, or breach of these Terms or Provider Terms.

  247. any card programme loss, chargeback, reversal, provisional credit, force post, negative balance, insufficient funds event, dispute cost, fraud loss, fee, cost, charge, or liability arising from or relating to your use of Card Services, your Account, your card, your instructions, your breach of these Terms or Provider Terms, your fraud, misuse, abusive activity, false or unsupported dispute, insufficient available assets or funds, unauthorised use caused by your failure to secure your Account, device, card or credentials, or any other act or omission by you.

  248. Lustum may control the defence and settlement of any claim covered by this Section. You must cooperate with Lustum and provide any information or assistance reasonably requested in connection with the claim.

  249. You must not settle any claim in a way that imposes any obligation, admission, liability, or restriction on Lustum without Lustum’s prior written consent.

  250. This indemnity applies to the fullest extent permitted by Applicable Law.

  251. Changes to These Terms

  252. We may update these Terms from time to time.

  253. If we make a material change to these Terms, we will take reasonable steps to notify you before the change takes effect, unless an immediate change is required for legal, regulatory, sanctions, security, provider, technical, operational, or business reasons.

  254. Any updated Terms will become effective on the date stated in the updated version or, if no date is stated, when they are made available through the Lustum App, website, email, or other reasonable means.

  255. Your continued access to or use of the Lustum App after updated Terms become effective means that you accept the updated Terms.

  256. If you do not agree to the updated Terms, you must stop using the Lustum App before the updated Terms become effective.

  257. Assignment

  258. You may not assign, transfer, delegate, or otherwise deal with any of your rights or obligations under these Terms without Lustum’s prior written consent.

  259. Lustum may assign, transfer, delegate, subcontract, or otherwise deal with any of its rights or obligations under these Terms to an affiliate, successor, acquirer, service provider, or other third party where reasonably necessary for its business, corporate restructuring, sale, merger, financing, regulatory, operational, or service-provider arrangements.

  260. Any attempted assignment or transfer by you in breach of this Section is void.

  261. Severability

  262. If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it valid, lawful, and enforceable.

  263. If such interpretation or modification is not possible, the relevant provision will be severed from these Terms.

  264. The remaining provisions of these Terms will continue in full force and effect.

  265. No Waiver

  266. A failure or delay by Lustum to exercise or enforce any right or remedy under these Terms does not operate as a waiver of that right or remedy.

  267. Any waiver must be in writing and will apply only to the specific circumstances for which it is given.

  268. A single or partial exercise of any right or remedy does not prevent any further or other exercise of that right or remedy.

  269. Entire Agreement

  270. These Terms, together with any documents expressly incorporated by reference, form the entire agreement between you and Lustum regarding your access to and use of the Lustum App.

  271. These Terms do not replace or limit any Provider Terms that apply between you and a Third-Party Provider.

  272. If any Provider Terms apply to your use of a Third-Party Service, those Provider Terms form a separate agreement between you and the relevant Third-Party Provider.

  273. Electronic Communications

  274. You agree that Lustum may communicate with you electronically, including through the Lustum App, email, push notification, in-app message, website notice, or other electronic means.

  275. Electronic communications may include notices, disclosures, confirmations, updates, security alerts, support messages, changes to these Terms, and other information relating to the Lustum App.

  276. You are responsible for keeping your contact details up to date and for monitoring communications sent to you through the Lustum App or to the contact details linked to your Account.

  277. Communications sent electronically will be treated as received when made available through the Lustum App, sent to your registered email address, or otherwise delivered by reasonable electronic means, unless Applicable Law requires otherwise.

  278. Governing Law and Disputes

  279. These Terms are governed by the laws of Hong Kong, unless mandatory law in your jurisdiction requires otherwise.

  280. Before starting any formal proceedings, you agree to first contact Lustum and give us a reasonable opportunity to resolve the issue informally, unless urgent legal relief is required.

  281. Any dispute, controversy, difference, or claim arising out of or relating to these Terms, the Lustum App, or your access to or use of the Lustum App, including the existence, validity, interpretation, performance, breach, or termination of these Terms, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.

  282. The seat of arbitration shall be Hong Kong. The arbitration shall be conducted in English. The tribunal shall consist of one arbitrator.

  283. Nothing in this Section limits Lustum’s right to seek urgent injunctive, interim, or protective relief from any court of competent jurisdiction where necessary to protect the Lustum App, its systems, intellectual property, users, Third-Party Providers, or compliance with Applicable Law.

  284. Any dispute relating to a Third-Party Service may need to be resolved under the applicable Provider Terms and with the relevant Third-Party Provider. These Terms govern only your relationship with Lustum in relation to the Lustum App.

  285. Contact

  286. If you have questions about the Lustum App or these Terms, you may contact Lustum at:

  287. Email address: [email protected]

  288. If your question, request, complaint, dispute, refund, chargeback, reversal, card issue, Wallet issue, Onramp, Offramp, KYC, KYB, AML and CFT Requirements, transaction approval, card authorization, settlement, payout, or other matter relates to a Third-Party Service, you may need to contact the relevant Third-Party Provider directly under its Provider Terms.

  289. Lustum will use commercially reasonable efforts to help identify the relevant Third-Party Provider and, where appropriate, assist with app-level communication. However, Lustum does not decide, approve, reject, process, reverse, settle, or resolve any matter relating to a Third-Party Service.
